Subclass 852 Referred Stay or Referred Stay Class DH Subclass 852 visa is for people who have assisted the Police in catching people involved in human trafficking or people smuggling
You can apply for a Subclass 852 Referred Stay permanent visa if you have assisted the Australia Federal Police (AFP) in catching people who were involved in human trafficking, slavery or slavery-like crimes.
You can only apply for a Subclass 852 Deferred Stay visa if you are invited. In addition, you must be in Australia and the Commander of the AFP issued a certificate to the Attorney General stating that you have made a contribution to, and cooperated closely with, an investigation of people who engaged in human trafficking and human slavery activities.
In addition, you must not be subject to the investigation mentioned in the Commander’s certificate or subject to a prosecution that commenced directly as a result of that investigation.
You must also be in danger if you were returned to your home country.
If you are invited to apply for the Subclass 852 Referred Stay visa, you must do so within 28 days of having received the offer.
Before the Department of Immigration (Department of Home Affairs) grant you the Subclass 852 Referred Stay visa, you must also pass the Character test, health test and ASIO has assessed that you are not a security risk, or you are not associated with the proliferation of weapons of mass destruction. In addition, granting you the visa is or would not be contrary to Australia’s foreign policy.
Including family members
You can include members of your family in a combined application for the Subclass 852 Referred Stay visa. Your family members include your partner (spouse or de facto partner), dependent children and parents.
There is no visa application charge or fee for Subclass 852 Referred Stay visa.
This is a permanent visa and is valid for 5 years from the date of visa grant (click here to learn more about RRV 155).
